Who is responsible for your data

Immersion Canada, Office 11/12 – Hôtel Carlton, Antananarivo, Madagascar (NIF 4018922353), is responsible for the data collected on this site.

Person in charge of the protection of personal information (under Quebec’s Law 25): Immersion Canada’s data protection officer, reachable at contact@immersioncanada.ca, subject “Personal data”.

This policy applies Malagasy Law No. 2014-038 on the protection of personal data and, for people in Canada, the Personal Information Protection and Electronic Documents Act (PIPEDA) and Quebec’s Act respecting the protection of personal information in the private sector (Law 25).

The data we collect

Through the contact form: your name, email and phone or WhatsApp number (required), the service you want (required) and, if you choose to give them, your date of birth, your intended budget and a description of your project.

Please do not include sensitive information in your message (health, opinions, criminal record, passport number): it is not needed for a first contact and will be requested, if necessary, through a secure channel.

Technical data: your IP address and information about your browser are processed by our host to run and secure the site, and by the form’s bot protection.

The site uses no advertising cookies, no audience measurement tool and no social media pixel. No data is sold.

Why we use it

To answer your request and set up your pre-assessment appointment, at your request (pre-contractual steps, article 17 of Law No. 2014-038). Your date of birth is only used for a first assessment of your eligibility, as age counts in several Canadian programs.

To protect the site and the form against bots and abuse (legitimate interest).

We use it for no other purpose. We do not send you marketing emails; should that change, it would only be with your express consent, as required by Canada’s Anti-Spam Legislation.

Who can access it

The Immersion Canada team handling your request and, when your project concerns Canadian immigration, the regulated consultant (CICC) who will handle your file.

Our technical service providers, acting only on our instructions: Cloudflare, Inc. (hosting, security and Turnstile bot protection), Faivelo (email delivery of the requests sent through the form) and our email provider.

No data is shared with any government body without your consent, unless required by law.

Transfers outside Madagascar and Quebec

Your data may be processed in Canada (by our Montreal office and our consultants) and in the United States (by Cloudflare). These transfers are needed to follow up on the request you send us knowingly (article 20 of Law No. 2014-038). Canada has data protection legislation.

Before entrusting personal information outside Quebec, we assess the protection it will receive there and cover the transfer by contract, as Law 25 requires. Data hosted abroad may be subject to that country’s laws, including access requests from its authorities.

How long we keep it

A request that does not lead to a service agreement is deleted 24 months after our last exchange.

If you become a client, your file is kept for the duration of our services, then for the period required by the CICC’s professional rules and by applicable accounting and tax obligations, before being deleted or anonymized.

Technical security data is kept by Cloudflare under its own policy, for a limited time.

How we protect it

The site is served over HTTPS only. The form is protected against bots and abusive submissions. Access to requests is limited to the people who need it, and our providers are bound to security and confidentiality (articles 15 and 16 of Law No. 2014-038).

If a confidentiality incident presents a risk of serious injury, we notify the people concerned and the competent authorities, as Canadian laws require.

Your rights

At any time and free of charge, you can: find out whether we hold data about you and get a copy (right of access); have it corrected, completed or deleted (right of rectification); object, on legitimate grounds, to its processing (right to object); and withdraw your consent.

People in Quebec can also ask for their information in a structured, commonly used technological format (portability) and be told which information was used for an automated decision. We make no fully automated decisions.

Write to contact@immersioncanada.ca, subject “Personal data”, stating your request. We may ask for proof of identity. We answer within 30 days at the latest.

If you feel your rights are not respected, you can contact Madagascar’s Commission Malagasy de l’Informatique et des Libertés (CMIL), the Office of the Privacy Commissioner of Canada (priv.gc.ca) or, in Quebec, the Commission d’accès à l’information (cai.gouv.qc.ca).

Cookies and local storage

The site sets no tracking cookies. Cloudflare’s bot protection analyses technical browser signals, only to tell a person from a bot when the form is used. You can block this in your browser; the form may then stop working, and you can write to us directly by email or WhatsApp.

Minors

The form is meant for adults. For a project concerning a minor, the request must be made by a parent or legal guardian.

Changes

We may update this policy, in particular if our services or the law change. The date of the last update is shown at the top of the page.
